GTC
These general terms and conditions of sale (hereinafter the "GTCS") apply to :
All of the services (hereinafter the "Services") offered by "Aquaparc" (hereinafter the "Park") owned by BICI Entertainement SA, registered under the number
CHE-108.514.941, having its registered office at Route de la Plage - 1897 Le Bouveret (hereinafter the "Seller"), to an individual customer (hereinafter the "Customer").
And any order and/or reservation made on the Aquaparc website (hereinafter the "Website") or on the Aquaparc website.
The information appearing on the Website or the Brochure, as well as the T&Cs constitute the pre-contractual information.
No derogation from these GCS will be accepted without the Vendor's prior written agreement. It is expressly stated that the information in the brochure and/or on the Internet may be subject to change during the season.
ARTICLE 1 - Description of Services
1.1 The Vendor offers Visitors (Customers and any persons accompanying them) the opportunity to spend a day in its water park to relax, experience emotions and thrills and enjoy the slides, a pirate ship, whirlpools and a Sharkyland area, which are located in four different universes: the Family Universe, the Kids Universe, the Sharkyland Universe and the Sensation Universe.
The Seller cannot be held responsible for non-essential differences between the photographs supplied and the Services.
The list of Services is not exhaustive and is subject to change; the Seller is free to delete, modify or offer new Services. The list of Services currently offered by the Vendor, together with their prices and conditions of validity, are available on the Website and in the brochure.
ARTICLE 2 - Prices
2.1 All prices are available on the website or at the park entrance. Prices are expressed in Swiss Francs and include all taxes, based on the taxes in force on the date the order is placed. They may be revised after publication of the brochure and at any time during the Park's opening season. Once the order has been confirmed, the sale price is guaranteed.
2.2 The elements included in the price of the Services are fully described on the dedicated areas of the Site. There are several Tariffs, based on different objective criteria. The Tariffs are :
Day rate, different for adults, children, kids, students/AVS, for the person accompanying a Kids, families (with either 2 adults and 2 children, or 1 adult and 3 children).
4H rate, different for adults, children and kids.
Different late entrances for adults, children and kids.
Gift voucher
Group rates for more than 20 people, with prior booking on the website.
In addition, special services (birthdays, comfort offers, etc.) are available at prices set out on the website.
The Ticket is valid on the date and for the duration specified on the Ticket.
It is also possible to buy a pass valid for six months (the advantages of this pass are defined on the website).
The car park is managed by the commune of Port-Valais. Payment is made on site using the parking meters provided. Aquaparc is in no way responsible for any events that may take place in the car park.
ARTICLE 3 - Placing an order or reservation
Tickets can be purchased on the website, at the park entrance or from authorised retailers.
The services on offer can be booked and purchased on the website or at the Park entrance.
All Ticket purchases are final. No Ticket may be exchanged or refunded, except in exceptional circumstances and solely at the Seller's initiative;
The Vendor draws the Customer's attention to the fact that undated tickets do not guarantee access to the Park on busy days.
Tickets are personal and non-transferable.
Order or reservation confirmation
When placing an order on the Website, Customers are invited to identify themselves using a form to create a personal Customer account, or alternatively they may place the order as a guest (email address required in order to receive tickets for the park).
Customers may check the details of their order and its total price at any time. To finalise the order, the Customer must read the GTCs. By purchasing a ticket, the Customer accepts these GTCs, which are applicable to him/her.
ARTICLE 4 - Terms of payment
4.1 Payment methods accepted
The Seller accepts the following means of payment:
Credit cards only: Visa; MasterCard and Twint
Gift Card
PayPal (on the site)
Apple Pay (at checkout)
REKA cheques only at the cash desk
Tickets must always be paid for in full before entering the Park.
Services and catering purchased during the day will be paid for on leaving the park.
ARTICLE 5 - Complaints
Complaints arising from a dispute concerning the performance of the Services must be made in writing by email to the following address: contact(at)aquaparc.ch .
In any event, complaints must be notified by the Customer within fifteen (15) days of the end of the Service.
To avoid any dispute, proof of visit (admission tickets, certificate, etc.) must be sent with the claim.
ARTICLE 6 - Liability
In particular, the Vendor decides on the opening days and times of the park and the related services it offers. The Vendor may decide to close all or part of the Park to the public and suspend all or part of the Services offered, for as long as it deems necessary, in particular due to issues or operations relating to the safety or health of visitors, maintenance, repair, rehabilitation, restructuring of all or part of the Park's equipment, bad weather, public order, privatisation of the Park or part of the Park, etc., without being able to be held responsible and without the Customer being able to claim compensation of any kind whatsoever.
The Vendor declines all responsibility for damage of any kind whatsoever and, in particular: theft, damage and/or loss likely to affect the effects, objects or equipment brought by visitors. Each visitor is responsible for any damage, direct or indirect, that he or she may cause while in the Park.
The Customer undertakes to comply with and to ensure that any persons accompanying the Customer comply with and apply the internal rules and all the safety rules posted in the Park. The Vendor shall not be held liable for any damage resulting from failure by the Customer or any visitor to the Park to comply with the safety rules.
The Vendor's authorised services have the right to expel any offender without recourse. Visitors who are expelled may under no circumstances obtain a refund of their admission tickets.
Force Majeure - The Vendor shall not be held liable in the event that the failure to comply with its obligations is due to a fortuitous event, a case of force majeure or the act of any person outside the Vendor's control, such as, but not limited to, strikes, fire, water damage, inaccessibility, weather conditions, epidemics, decisions made by the authorities, etc. The Vendor shall not be held liable in the event that the failure to comply with its obligations is due to a fortuitous event, a case of force majeure or the act of any person outside the Vendor's control. Any situation beyond the control of the Vendor and any service provider involved in the performance of the Service, the consequences of which could not have been avoided even if all reasonable measures had been taken, and which prevents the performance of all or part of the obligations set out in the contract.
ARTICLE 7 - Personal data
In accordance with the RGPD regulations in force in Switzerland since 1er September 2023, the Customer is hereby informed that his/her personal data is subject to automated processing by the Direction du Parc, for the purpose of managing the commercial relationship, responding to his/her requests, sending him/her our newsletter and providing him/her with any information about our company and/or our Services. The recipients of the data are the Park Management, its staff who are authorised to have access to the Customer's data by virtue of their position, in particular the sales and accounting departments, and sub-contracted service providers acting on the strict instructions of the Park Management.
Customer data is kept for no longer than is necessary for the purposes for which it was collected and, in any event, for no longer than two (2) years from the date of our last unanswered request, unless the Customer deletes or objects in the meantime.
The Customer is informed that he may, at any time, exercise his rights of access, rectification, deletion, opposition, limitation of processing and portability for the information concerning him by contacting us at the following address: Bici Entertainment SA, Route de la plage, 122, 1897 Le Bouveret - Switzerland and contact@aquaparc.ch. A reply will be sent within one month.
The Park's management is concerned about its customers' personal data and takes appropriate protective measures to ensure their security, integrity and confidentiality. For more information on the Park's personal data policy, customers are invited to consult the personal data protection charter on the Park's website.
All personal data will be kept confidential. Only the data required to carry out the commercial process will be kept.
ARTICLE 8 - Applicable law
Both the interpretation and implementation of these GTC are governed by Swiss law.
ARTICLE 9 - Dispute resolution
Any dispute arising between the parties must be resolved as a matter of priority by amicable settlement.
After having sent the complaint to the Vendor in accordance with the terms of article 5 above, and without a satisfactory response from the Vendor and failing to reach an amicable agreement, it will be possible to bring the matter before the competent court.
The competent court will be determined with regard to the Park's domicile.
